By accessing or using Simmerce ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Platform.

You may use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Platform for any unlawful or fraudulent purpose
• Upload content that infringes intellectual property rights of any third party
• Attempt to reverse-engineer, scrape, or extract data from the Platform
• Interfere with the security or integrity of the Platform or its infrastructure
• Use the Platform to generate misleading or deceptive customer insights

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent or abusive purposes.

You retain ownership of any product data, descriptions, screenshots, or other content you upload to the Platform ("Your Content"). By uploading Your Content, you grant us a limited, non-exclusive license to use it solely to provide the simulation services.

You are responsible for ensuring that Your Content does not violate any applicable laws or third-party rights.

Simulation results are generated by AI models and are intended for directional insight only. They are not a substitute for real user research, A/B testing, or other forms of empirical validation. We make no warranties about the accuracy, completeness, or fitness of simulation results for any particular purpose.

You should not make high-stakes product or business decisions based solely on synthetic simulation results.

The Platform, including its design, software, and AI models, is owned by Simmerce and protected by applicable intellectual property laws. Nothing in these Terms grants you a right to use our name, trademarks, or logos.

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, Simmerce shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform.

We may update these Terms at any time. We will notify you of material changes by email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation before resorting to formal proceedings.
